ALPINE TRAINING CENTRE SCIO (ATC)


Introduction

  1. These booking terms (“Booking Terms”) set out the terms and conditions applicable to all ski camps (whether residential or non residential) (“Camps”) for all Trainees, Alpine Training Centre SCIO (Registered Charity Number SC050509) of Tigh an Uillt, Nethy Bridge, Cairngorm National Park, Scotland PH25 3DR (“ATC”). A description of and information pertaining to each Camp is set out on the ATC website at http://www.atccharity.com and or as outlined in emails between the Trainee and admin@alpinetrainingcentre.com (“Camp Details”).

    Bookings and Agreement (Contract)

  2. Any application for participation of a person (“Trainee”) on a ski Camp must be made to ATC by the Trainee (if over the age of 18) or by the parent or guardian (if under age 18) via the ATC website, www.atccharity.com or by emailing admin@alpinetrainingcentre.com, or by telephoning 07940017548) (“Booking Form”). The completed Booking Form must be accompanied by the relevant deposit or full payment set out in the Camp Details (“Payment”) on line via the ATC website. Upon receipt of the completed Booking Form and the Payment, ATC will issue a confirmation of payment e-mail. Upon receipt of such e-mail, a contractually binding agreement (“Contract”) will be created between the Trainee (or the parent/guardian named on the Booking Form if the Trainee is under the age of 18) and ATC on the basis of these Booking Terms, the Camp Details and the completed Booking Form.

  3. By booking online, parents/guardians are authorising ATC to act in loco parentis, and are agreeing to be bound by ATC’s full Terms and Conditions, our athletes code of conduct, our parents code of conduct, our anti-bullying policy and our disciplinary procedures.

  4. By booking online, parents/guardians are confirming to ATC that their children are attending Camps with; comprehensive winter sports insurance that covers ski racing, ski race training and mountain helicopter recovery, a valid passport, a valid EHIC card, a completed medical consent form and a completed travel consent form.

  5. The facilities at many of the locations used for Camps may not be suitable for Trainees with special needs. Most of these facilities are out with our control. Although ATC can accept bookings for most Trainees with special dietary requirements, the nature of the training provided and the location of the Camps is such that unfortunately it may be difficult to accommodate Trainees with special needs.

  6. Bookings for Trainees who make their own travel and accommodation arrangements in and around the Camp location (“Outliers”), will be accepted subject to availability of places.

  7. Due to the complexities of organising and running the Camps, bookings will only be accepted by ATC for the whole period of each Camp or for certain parts of each Camp (usually complete weeks), details of which are set out in the Camp Details. Bookings may be accepted for periods of less than a complete week, but payment must be made for the whole week or such other part of the Camp as may be referred to in the Camp Details or agreed to in writing by ATC.


    Cancellation and Refunds

  8. If you cancel more than 2 weeks prior to the start of the Camp you will be issued with a refund of your payment minus an admin fee of £100.00. If you cancel within 2 weeks prior to the start of the Camp, no matter the reason, you will not be entitled to any refund. We strongly recommend that trainees have cancellation and curtailment insurance.

  9. You must provide ATC with a completed Medical Form prior to the Camp start date and if you fail to do so, ATC shall be entitled to terminate the Contract and you will not receive any refund. If the Trainee has to curtail participation in the Camp or has to withdraw whether due to sickness, injury or otherwise during the Camp, no refund will be paid to you.

  10. For each Camp, a minimum number of people are required to book to enable the Camp to take place. ATC will assess whether the minimum number has been achieved and inform you as soon as reasonably practicable (and usually not less than 4 weeks before departure) if it becomes necessary to cancel a Camp for this reason. In the event of cancellation of a Camp for this reason, the Contract will simultaneously be terminated and in such circumstances, ATC will refund all sums paid by you to ATC in respect of that Camp.

  11. In the event of curtailment of a Camp or inability to ski during a Camp because of inclement weather or lack of snow, or any event or occurrence beyond the reasonable control of ATC, you should note that you will not be entitled to any refund from ATC.

  12. In the event of inclement weather or lack of snow during a Camp, or any event or occurrence beyond the reasonable control of ATC, ATC may use reasonable endeavours to re-site elements of the Camp, however this may result in extra costs which will be passed on to you. These costs will need to be paid immediately on the day, or by the end of the Camp.

  13. If ATC requires to cancel a Camp prior to the start because of inclement weather or lack of snow, or any event or occurrence beyond the reasonable control of ATC, ATC will endeavour to re-site the Camp. In the event that this results in extra costs, these will be passed on to you. However, where the increase in costs payable by you is 10% or more, you will have the right to terminate the Contract if you do so [prior to the start of the Camp]. If you do so terminate, you will receive a full refund of all sums paid by you to ATC.

  14. For the avoidance of doubt, you are entitled to a full or partial refund in the circumstances set out in Clauses 8,10, and 13 of these Booking Terms but in in no circumstances will compensation be payable to you by ATC.

    Insurance

  15. You must ensure that the Trainee has full medical insurance, mountain helicopter recovery, comprehensive travel insurance and is insured for ski racing and skiing off piste. We also strongly recommend that you take out cancellation and curtailment insurance.

    Equipment 

  16. ATC will not be responsible for any lost equipment or kit belonging to or hired by Trainees.

  17. You must ensure that the Trainee’s ski equipment is in full working order prior to the Camp. If you are hiring equipment, you are responsible for the cost of hiring.

    Trainee Behaviour

  18. All Trainees must comply with the ATC Code of Conduct for Trainees set out on http://www.atccharity.com If a Trainee’s behaviour is such that in ATC’s reasonable opinion a Camp is at risk of being disrupted, another Trainee is inconvenienced or adversely affected or ATC considers that the reputation of ATC has been or could be put in jeopardy, the Trainee may be asked to leave the Camp. Without prejudice to the foregoing generality, if a Trainee is found to have been drinking alcohol, taking illegal drugs, stealing, engaging in another criminal act, involved in sexual activity or in the reasonable opinion of ATC, generally displaying antisocial behaviour, the Trainee will be expelled from the Camp and the Contract will automatically be terminated.

  19. If the Trainee is to be expelled from the Camp, you will be informed and you will require to make immediate arrangements for the Trainee to travel home at your full expense. For the avoidance of doubt, no refund or compensation will be paid to you and the cost of any other accommodation and travel expenses will be your responsibility.

    Outliers

  20. Outliers will be responsible for their own transport to and from the slopes or other venue where training is to be held. In view of difficulties encountered in the past with hoteliers, Outliers will only be able to use the accommodation arranged by ATC for other Trainees for meals by prior arrangement with ATC. Outliers will not be entitled to use such accommodation for other purposes such as ski waxing or eating packed lunches, neither will they be permitted access to resident Trainees’ bedrooms.

    Consent  and Personal Data

  21. By completing the on line Booking Form you are consenting to ATC staff acting [in loco parentis] in relation to the Trainee and the Trainee being videoed for coaching and performance purposes. Consent to medical treatment for the Trainee is dealt with in the medical consent form.

  22. Occasionally photographs and skiing footage of Trainees may be used in ATC publicity material (including social media) for promotional purposes. By completing and submitting the Booking Form, you also consent to such photographs and video of the Trainee being used for these purposes. If you do not in fact so consent, please specify accordingly on the Booking Form.

  23. ATC will keep any medical information provided by you confidential and will comply with its obligations under the Data Protection Act 1998 and related legislation in respect of such information.

    Liability and Indemnity

  24. ATC shall have no liability for any indirect or consequential loss arising under or in connection with the Contract. Nothing in the Contract shall limit or exclude ATC’s liability for (i) death or personal injury caused by its negligence; or (ii) fraud or fraudulent misrepresentation.

  25. ATC’s total liability in respect of all other losses arising under or in connection with the Contract shall be limited to the full cost of the relevant Camp (being the Deposit plus the Balance).

  26. ATC shall not be liable as a result of any delay or failure to perform its obligations under the Contract as a result of events like inclement weather, lack of snow, industrial disputes, failure of any transport system or resort uplift, accident or default of suppliers or subcontractors, or any other event or occurrence beyond the reasonable control of ATC.

  27. You will indemnify ATC in respect of all costs incurred by ATC in relation to the Trainee which in terms of the Contract are payable by you.

    General

  28. Following termination, those Clauses which by implication survive termination shall continue in full force and effect.

  29. The Contract shall be governed by and construed in accordance with Scots law and the Scottish Courts shall have exclusive jurisdiction.
